This Change Has Been a Long Time Coming

We started Silly Nice in March 2024, right here in Harlem, New York. And from day one, we understood something that a lot of people in the cannabis industry still overlook: legalization isn't just a policy shift — it's a cultural moment. It's a reckoning with decades of over-policing, economic exclusion, and community harm, wrapped inside a business opportunity that, for once, actually has a chance to give something back. That matters to us deeply, as a Black-owned, Veteran-owned, family-run operation. We didn't just want to sell great cannabis. We wanted to be part of a movement that finally gets it right.

New York's Marihuana Regulation and Taxation Act — the MRTA — was signed into law in March 2021, and with it came promises: equity licenses, community reinvestment funds, and a legal framework designed to prioritize people from communities most harmed by prohibition. Three years in, the rollout has been complicated, uneven, and at times frustrating. But the change is real. And on the ground, block by block, borough by borough, something is genuinely shifting. We see it every day as our products reach over 150 licensed adult-use dispensaries across New York State. The landscape is transforming, and we want to talk about what that actually looks like.

Prohibition Left Marks That Don't Disappear Overnight

In New York City alone, cannabis arrests disproportionately targeted Black and Latino communities for decades — even as cannabis use rates remained consistent across racial lines. Those arrests cost people jobs, housing, and futures. Legalization can't undo all of that. But a legal market that creates pathways for people from those same communities to build real businesses? That starts to mean something. We carry that weight with us. These aren't just storefronts. The economic footprint is growing, too. Licensed dispensaries hire locally. They pay taxes. They participate in the neighborhood economy in ways that underground markets never could. And because New York's equity licensing framework gave priority to Conditional Adult-Use Retail Dispensary licenses (CAURDs) for applicants with prior cannabis convictions, many of these new shop owners are people who were once harmed by the very laws they're now building businesses around. From New York City to Upstate — The Changes Are Uneven

One of the realities of legalization in a state as geographically and culturally diverse as New York is that the change doesn't land the same everywhere. New York City — especially Manhattan, Brooklyn, and Queens — has seen faster dispensary growth, more consumer education, and more visible cultural acceptance. But upstate communities in places like Rochester, Buffalo, Albany, and the Hudson Valley are experiencing the shift differently. In some areas, licensed dispensaries are the first legal cannabis retail presence these communities have ever had. In others, resistance from local municipalities has slowed things down considerably.

New York gave municipalities the option to opt out of allowing adult-use dispensaries within their borders — and hundreds of towns and villages did exactly that. This creates a patchwork across the state where your access to legal cannabis depends heavily on your ZIP code. For communities that opted in, legal cannabis is bringing jobs, tax revenue, and a new category of small business. For communities that opted out, residents still often drive across county lines or, worse, continue relying on unlicensed sources. As a brand built in Harlem but sold across New York State, we have a stake in this conversation. Let's be honest with our community, because that's what we do. The unlicensed cannabis market in New York hasn't gone away. In fact, for the first year or two after legalization, it arguably grew — fueled by slow licensing, too few legal dispensaries, and consumer confusion about where to legally buy. That's been harmful to everyone trying to build a legitimate industry. Unlicensed products aren't lab-tested. They aren't labeled with accurate THC percentages. New York's equity framework was groundbreaking on paper. Priority licensing for people directly impacted by the war on drugs. A seed-to-sale system designed to prevent large multistate operators from dominating the market at launch. A social equity fund to redistribute cannabis tax revenue back to harmed communities. These were bold commitments. The execution, as many equity licensees will tell you, has been painful — plagued by delays, legal challenges, and funding gaps that left promising operators hanging without capital or open doors.

We navigated that same environment. We launched Silly Nice in March 2024 as a small-batch, family-operated brand, and we built our distribution one relationship at a time — reaching over 150 licensed dispensaries across New York State not through deep pockets or corporate backing, but through product quality, community trust, and hustle. We're not going to pretend the system worked perfectly for us or for everyone. But we're proof that it can work. And we'll keep advocating for the policies and funding that make the promise of equity real for more people.

Real equity in this industry looks like a Black veteran from Harlem being able to build a brand that sits on shelves next to brands with far more funding and far less story. And we believe as legalization matures, more of the industry will have to as well.

New York's adult-use market is still young. More dispensary licenses will be issued. More equity operators will get their footing. The regulatory environment will evolve — and with it, so will consumer expectations. We're here for all of it.
