New York State legalized adult-use recreational cannabis in 2021 under the Marijuana Regulation and Taxation Act. This means that if you are 21 years of age or older, you are legally permitted to purchase and possess cannabis from a licensed adult-use dispensary in New York State — and yes, that applies to international visitors as well. Your legal status as a tourist does not prevent you from participating in the legal cannabis market.

What Is and Is Not Allowed

Adults 21 and older may legally purchase up to three ounces of cannabis flower or 24 grams of concentrated cannabis at one time. You must purchase from a licensed dispensary — not from unlicensed street vendors or smoke shops, which operate outside the law and may carry unsafe or unregulated products. Smoking or vaping cannabis in public places where cigarette smoking is prohibited is not allowed in New York City. This means no smoking on sidewalks in densely populated areas, in parks where smoking is banned, or inside restaurants, bars, and most public buildings.
