Understanding NYC Cannabis Laws as a Visitor from Peru
New York State legalized adult-use cannabis in 2021, and the licensed dispensary market has grown rapidly since. As a visitor, here is what you need to know before you walk into any shop.
Who Can Purchase Cannabis Legally in NYC
Cannabis is legal for any adult aged 21 or older. That includes tourists and international visitors. Your nationality does not matter — your age does. If you are 21 or older and visiting from Peru, you are fully within your rights to purchase cannabis at any licensed adult-use dispensary in New York State. You do not need a New York ID. A valid passport is completely acceptable and is actually our recommended form of identification to carry with you.
Where You Can and Cannot Consume
New York law permits adults to consume cannabis in private spaces and in licensed consumption lounges. Public smoking of cannabis — on sidewalks, in parks, near schools, or inside restaurants and hotels — is prohibited and can result in fines. Some consumption lounges have opened across the city, particularly in Manhattan and Brooklyn, where you can enjoy your purchase in a social, legal setting. Always ask the dispensary staff about nearby consumption-friendly options when you make your purchase. And of course, never drive after consuming cannabis. Plan your transportation ahead of time — NYC's subway and rideshare apps make that easy.
Licensed Dispensaries Are the Only Legal Option
Only licensed dispensaries are authorized to sell adult-use cannabis in New York. Buying from unlicensed street sellers or unlicensed delivery apps puts you at legal risk and, more importantly, at health risk since those products are unregulated and untested. Stick to licensed shops. New York City is massive, and dispensaries are scattered across all five boroughs. That said, certain neighborhoods have become known for their density of licensed cannabis shops, making it convenient for visitors staying in those areas.
Midtown Manhattan
