From all of us at Silly Nice, welcome to New York City. We're Shane Breen and LeVar Thomas — two Brooklyn-based partners of 25 years, founders of a small-batch cannabis brand we built from the ground up. Shane is a U.S. Army Veteran. Understanding Cannabis Laws in New York — What You Need to Know as a Visitor
New York State legalized adult-use recreational cannabis in March 2021 through the Marijuana Regulation and Taxation Act (MRTA). That means adults 21 years of age and older can legally purchase, possess, and consume cannabis products purchased from licensed dispensaries throughout the state — including all five boroughs of New York City. This is fully legal at the state level, and as an international visitor, you are absolutely permitted to purchase cannabis from a licensed retailer as long as you are 21 or older and can present valid identification.
What ID Do You Need?
Your Tunisian passport is your best friend here. Every licensed dispensary in New York will accept a valid government-issued photo ID to verify your age. Your passport absolutely qualifies. Bring it with you — don't rely on a photocopy or a phone image. Budtenders are required by law to check ID, and they will. Presenting your passport is quick, easy, and completely routine in any NYC dispensary.
Important: Cannabis Laws Back Home in Tunisia Are Very Different
We want to be fully transparent with you, out of respect. Cannabis remains illegal in Tunisia under Law 92-52, and penalties for possession or use can be severe — including mandatory minimum prison sentences. What you do in New York City under New York law has no bearing on what you do when you return home. However, it is absolutely critical that you do not attempt to travel internationally with cannabis products. Cannabis cannot be transported across international borders, including through airports like JFK, LaGuardia, or Newark. TSA agents are federal employees, and while they are not focused on cannabis, federal law still prohibits interstate and international transport of cannabis. Consume what you purchase here, in New York, within the city. Do not pack it. Do not check it. Do not attempt to bring it home. This is non-negotiable, and we say it because we care about your safety.
Where You Can and Cannot Consume Cannabis in New York City
New York's cannabis laws give adults the right to consume, but there are real boundaries. You can consume cannabis in private residences — meaning if you're staying somewhere that permits it, your accommodation is generally your best bet. You cannot smoke or vape cannabis in public spaces, including parks, sidewalks, streets, or anywhere that tobacco smoking is prohibited. The rules mirror tobacco restrictions very closely. You also cannot consume cannabis in hotel lobbies, on public transit, in taxis or rideshares, or in any enclosed public space. If your hotel is non-smoking, that applies to cannabis as well — check your accommodation policy before you light anything up.
