Cannabis Is Legal in New York — Here's What That Means for You as a Visitor
New York State legalized adult-use recreational cannabis in March 2021 under the Marihuana Regulation and Taxation Act (MRTA). That means adults 21 years of age and older — including international tourists and visitors — can legally purchase cannabis from licensed dispensaries across New York City and the entire state. You do not need to be a New York resident. You do not need a medical card. You simply need to be 21 or older and have valid identification.
As a visitor from Ukraine, your passport is your best friend at any dispensary. Bring it with you — every time, without exception. Budtenders at licensed dispensaries are required by law to check ID before completing any sale, and a Ukrainian passport is widely accepted as valid government-issued identification. No passport, no purchase — it's that simple, and it's the law.
What You Can Buy, Possess, and Where You Can Use It
Adults 21 and over can legally possess up to three ounces of cannabis flower and up to 24 grams of concentrated cannabis products in New York State. You can purchase cannabis from any licensed adult-use dispensary. However, public consumption is prohibited — meaning you cannot smoke or use cannabis on streets, sidewalks, parks, or any public space where cigarette smoking is also banned. Use cannabis only in private settings, such as in your hotel room if your accommodation allows it, or in designated private spaces. Never consume cannabis in vehicles, and never drive or operate any vehicle after using cannabis.
A Note on Cannabis Laws in Ukraine vs. New York City
We want to be straightforward with you: cannabis remains illegal in Ukraine, including for recreational use. Possession, purchase, or use of cannabis in Ukraine carries serious legal consequences. The laws that apply during your time in New York City do not follow you home. Whatever you enjoy legally here in NYC must stay here — you cannot legally carry cannabis across international borders, including back to Ukraine. This is a matter of both Ukrainian law and international customs regulations. Always make responsible decisions, and always be informed about what is and is not permitted when your trip ends.
