New York State legalized adult-use recreational cannabis in 2021 under the Marijuana Regulation and Taxation Act (MRTA). What You Are Allowed to Do

What You Are Not Allowed to Do

Public consumption — meaning smoking or vaping cannabis on sidewalks, in parks, near schools, or in public transit — is prohibited under New York law and carries a fine. You cannot consume cannabis inside hotels unless the property has specifically designated spaces for it. You cannot take cannabis products across state or international borders — including back to Venezuela — regardless of how they were purchased. Please do not attempt to travel with cannabis products. This is critical. New York City has unlicensed shops, smoke shops, and street vendors selling unregulated cannabis products.
