New York Cannabis Is Different — And That's the Point

New York's adult-use cannabis market is younger than California's and Colorado's, but that doesn't make it lesser — it makes it hungrier. As Silly Nice, a Black-owned, Veteran-owned, family-run brand based in Brooklyn, we launched in March 2024 and are now carried in 150+ licensed adult-use dispensaries across New York State. We've studied every market carefully, because we had to. Here's what we know: New York is not playing catch-up. It's playing its own game.

California legalized adult-use cannabis in 2016. Colorado did it in 2012. New York's Marihuana Regulation and Taxation Act passed in 2021, with licensed dispensaries opening through 2022 and beyond. On paper, we're the new kid. But anyone who's spent time in the Bronx, in Bed-Stuy, in Harlem, in Astoria — anyone who knows New York — understands that late entry doesn't mean slow quality. New Yorkers don't accept second-best. That standard has shaped every product we make.

What Makes a Cannabis Market Mature?

Maturity in a cannabis market isn't just about how long it's been legal. It's about equity policy, consumer sophistication, product diversity, lab testing standards, and the brands that emerge from within the community. By those measures, New York is developing a market identity that California and Colorado simply didn't have at launch — one built with explicit equity frameworks, CAURD licensing for justice-involved entrepreneurs, and a consumer base that has always demanded authenticity. We fit here because this market was built for brands like ours.

California: The Pioneer With Growing Pains

California built the cannabis blueprint — no question. The legacy of Prop 215, the medical era, the brands born in Oakland and Los Angeles and Humboldt County — that culture shaped how the entire nation thinks about cannabis. The diversity of strains, the craft genetics scene, the artisanal hash movement — much of what we love about high-quality cannabis was refined or popularized in California. We respect that history deeply.

But California's legal market has also been one of the most troubled in the country. High tax burdens — some of the steepest in the nation — have kept illicit market prices competitive with licensed dispensary prices. Licensing backlogs locked out small operators for years. Many equity applicants who were supposed to benefit from the legal market found themselves priced out, outpaced by multi-state operators, or simply drowning in bureaucracy. The promise of California cannabis hasn't always matched the reality for the communities who built that culture.

Colorado: The Infrastructure Blueprint

Colorado was the first state in the country to open adult-use cannabis dispensaries in January 2014. That's a twelve-year head start on New York. The Colorado market has had time to normalize — pricing has dropped, product variety is broad, and the regulatory framework has been refined through years of iteration. For anyone studying how a legal market matures, Colorado is the case study.

Colorado has also dealt with its own equity gaps. The communities most harmed by prohibition — overwhelmingly Black and Latino communities — weren't positioned to benefit from early licensing. The legal market there, like in California, initially rewarded those with access to capital, real estate, and legal infrastructure. Colorado has taken steps to address this in recent years, but the head start went largely to operators who didn't look like us. We see New York's equity framework, however imperfect, as an opportunity to do better from the jump.

Colorado's mature market has driven prices down — which sounds like a win, but often comes at the cost of craft quality and small-batch integrity. New York pricing is higher right now, and that reflects real costs: local labor, New York real estate, state tax structures, and the premium of producing honestly. The Equity Argument: New York Has a Chance to Get It Right

Here's the truth that too many cannabis market comparisons skip over: the states that legalized first didn't lead on equity. They led on access for the already-advantaged. California and Colorado's early years saw the wealth from legal cannabis flow primarily to white-owned, well-capitalized operations, while communities that bore the brunt of drug war enforcement were still tangled in criminal records, denied licenses, and priced out of participation.

New York built its framework with that history in mind. The CAURD program — Conditional Adult-Use Retail Dispensary licenses — was specifically designed for justice-involved applicants, prioritizing those most harmed by prohibition. The Office of Cannabis Management was given an equity mandate. That doesn't mean the system is perfect — far from it. But the intention embedded in New York's structure represents a meaningful departure from what came before. As a Black-owned, Veteran-owned brand, we don't take that lightly.
